The Executor of an Estate has a duty to defend the last Will made by the deceased
person. That means that in the event of an Estate dispute, they are to oppose any
challenges brought against the Will or the Estate as far as is reasonable in the
circumstances, and they are to protect the inheritance of the Beneficiaries named
in the Will.
What constitutes defending the Will reasonably is a complex legal question. We make
it our business to explain to all Executors their obligations to ensure that they
act reasonably throughout a Will or Estate dispute.
An Executor, acting reasonably, will usually receive their costs of engaging a Lawyer
during a Will and Estate dispute from the Estate. If you are an Executor and the
Will or Estate you are administering is disputed, speaking with one of our experienced
Estate Lawyers can make a stressful process much easier for you.
