The Personal Representative or Executor of the Will has an obligation to defend the terms of the Will. You should get independent advice if the Personal Representative:

  • Has not taken steps to protect your inheritance;
  • Has not made your rights in the dispute clear;
  • Does not keep you informed with how the dispute is progressing;
  • Does not have the same view as you in relation to the defence of your inheritance; or
  • Is the Public Trustee or a professional Trustee or Executor Company.

It is common for the Public Trustee or a Professional Trustee or Executor Company to be appointed as Executor under a Will. Professional trustees are effective at administering Deceased Estates but in our experience, if an Estate becomes the subject of a dispute they prefer for the interested beneficiaries to defend their own gift.
