The Executor of an Estate, during a Will or Estate dispute has a duty to defend
the last Will made by the deceased person. That means that as far as is reasonable
in the circumstances, they are to oppose any challenges brought against the Will
or the Estate and they are to protect the inheritance of the Beneficiaries named
in the Will.
What constitutes defending the Will reasonably is a complex legal question. We make
it our business to explain to all Executors their obligations to ensure that they
act reasonably throughout a Will or Estate dispute.
An Executor, acting reasonably, will receive their costs of engaging a Lawyer during
